This bug has been fixed in 10.6.3, so if you are running Snow Leopard be sure to grab the latest update.

so is this "just" a snow leo prob? what about leo?

further more:
i have converted many flacs to alacs with max v0.8.1.
are they 100%? plz confirm.

It's difficult to say without performing a test on each OS version when the bug was introduced. I had not noticed it before this so it is likely it came out in SL or possibly even 10.6.1 or 2.

The simplest solution is to delete the iTunSMPB atoms from your files using AtomicParsely as mentioned above. This will guarantee that the files don't have incorrect gapless data.
