FLAC encoder artifacts?

I recently ripped my CD collection using MAX and had the encoder give me an mp3 copy and a flac copy.
I've just noticed that some of the flac versions have small audible artifacts - clipping- occasionally. These do not exist in the mp3 version.
Why?
It's kind of a bummer that I didn't notice it until after I dumped my CDs at the local thrift store.

It is definitely odd that your FLAC files have problems and your MP3 files don't. Internally, Max sends the same intermediate files to the encoders so the two formats had the same source. I can't explain why your FLAC files have problems, though; one possibility is that the CDs had scratches with audible artifacts that were masked by the MP3 encoder.

Thanks for the reply.

It doesn't make much sense to me either.

My mp3 resolution is fixed rate 320. Hard to imagine much masking of artifacts at such good resolution.
